Children and individuals with developmental disabilities compared to typical participants are disadvantaged not only by virtue of being vulnerable to risks inherent in research participation but also by the higher likelihood of exclusion from research altogether. Current regulatory and ethical guidelines although necessary for their protection do not sufficiently ensure fair distributive justice. Yet, in view of disproportionately higher burdens of co-occurring physical and mental disorders in individuals with DD, they are better positioned to benefit from research by equitable participation. (...) Greater elucidation of this ethical dilemma is called for by researchers, institutional review boards, and funding agencies to urgently redress the imbalance. This article discusses many of the regulatory principles to ensure better research participation of children and individuals with DD: human rights, validity, distributive justice, beneficence/nonmaleficence, and autonomy. Proves Completeness for the Evidential Conditional.

The application of neurostimulation techniques such as deep brain stimulation —often called a brain pacemaker for neurological conditions like Parkinson's disease —has generated “currents of hope.” Building on this hope, there is significant interest in applying neurostimulation to psychiatric disorders such as major depression and obsessive-compulsive disorder. These emerging neurosurgical practices raise a number of important ethical and social questions in matters of resource allocation, informed consent for vulnerable populations, and commercialization of research.

This paper addresses the alleged tension between the kind of strong apophaticism endorsed by Maimonides and his view of worshiping God. After considering some extant resolutions to this problem, I offer a proposal that utilizes the role of silence and imitative activity in Maimonides. While this solution may not have been one that Maimonides would have offered, I argue that Maimonides had conceptual resources for offering a promising solution within his theological framework.

With a few exceptions, much of epistemology in the last century has been dominated by discussions centered on knowledge, and in particular propositional knowledge (along with associated concepts such as justification, the reliability of cognitive processes, etc.). Recently, attention has been given to other cognitive states such as understanding and wisdom, due in some part to the resurgence of theorizing about intellectual virtues. As with typical epistemic concepts such as justification and knowledge, offering an analysis of wisdom has been difficult. (...) In this paper, I critique a recent attempt to analyze wisdom as risk-taking, and after gleaning from the insights of Thomas Aquinas, I defend a particular version of the wisdom-as-understanding approach. Subsequent consent can be morally efficacious. First, it licenses nostalgia and dismissiveness no more than its prior cousin does. Second, it's coherent because linked to the mental state of not minding. Third, it's just as vulnerable to bilking as prior consent is, as is clear once we distinguish between basing moral assessments on expectations versus on actual outcomes. Fourth, mind control is illegitimate because it short circuits the subject's will, not because its consent is subsequent. Finally, our intuitions about rape (...) show that dissent sometimes outweighs consent in matters of sex, not that subsequent consent is always inefficacious. (shrink)

Bellʼs 1964 theorem causes a severe problem for the notion that correlations require explanation, encapsulated in Reichenbachʼs principle of common cause. Despite being a hallmark of scientific thought, dropping the principle has been widely regarded as much less bitter medicine than the perceived alternative—dropping relativistic causality. Recently, however, some authors have proposed that modified forms of Reichenbachʼs principle could be maintained even with relativistic causality. Here we break down Reichenbachʼs principle into two independent assumptions—the principle of common cause proper and (...) factorization of probabilities. We show how Bellʼs theorem can be derived from these two assumptions plus relativistic causality and the law of total probability for actual events, and we review proposals to drop each of these assumptions in light of the theorem. In particular, we show that the non-commutative common causes of Hofer-Szabó and Vecsernyés fail to have an analogue of the notion that the common causes can explain the observed correlations. Moreover, we show that their definition can be satisfied trivially by any quantum product state for any quantum correlations. We also discuss how the conditional states approach of Leifer and Spekkens fares in this regard. (shrink)

Part I of this essay supports the anti-egalitarian conclusion that individuals may readily become entitled to substantially unequal extra-personal holdings by criticizing end-state and pattern theories of distributive justice and defending the historical entitlement doctrine of justice in holdings. Part II of this essay focuses on a second route to the anti-egalitarian conclusion. This route combines the self-ownership thesis with a contention that is especially advanced by G.A. Cohen. This is the contention that the anti-egalitarian conclusion can be inferred from (...) the self-ownership thesis without the aid of additional controversial premises. Cohen advances this contention, not because he wants to support the anti-egalitarian conclusion, but rather because he wants to emphasize the need for one to reject the self-ownership thesis if one is to reject the anti-egalitarian conclusion. In Part II of this essay, I support this second route to the anti-egalitarian conclusion by reinforcing Cohen's special contention while rejecting his challenges to the self-ownership thesis. Cohen's special contention is reinforced by way of an explanation of why the redistributive state must trench upon some people's self-ownership rights. One important challenge to the self-ownership thesis is answered through the articulation of a new and improved Lockean proviso. Another challenge offered by Cohen is answered by arguing that the philosophical costs of denying the self-ownership thesis are as great as the self-ownership libertarian maintains. Thus, I defend both of the key elements of self-ownership libertarianism, the self-ownership thesis and the anti-egalitarian conclusion. (shrink)

Uncertainty and affect are fundamental and interrelated aspects of the human condition. Uncertainty is often associated with negative affect, but in some circumstances it is associated with positive affect. In this paper, we review different explanations for the varying relationship between uncertainty and affect. We identify “mental simulation” as a key process that links uncertainty to affective states. We suggest that people have a propensity to simulate negative outcomes, which results in a propensity towards negative affective responses to uncertainty. We (...) also propose the existence of several important moderators of this process, including context and individual differences such as uncertainty tolerance, as well as emotion regulation strategies. Finally, we highlight important knowledge gaps and promising areas for future research, both empirical and conceptual, to further elucidate the relationship between uncertainty and affect. (shrink)

The miracle argument for scientific realism can be cast in two forms: according to the miraculous theory argument, realism is the only position which does not make the empirical successes of particular theories miraculous. According to the miraculous choice argument, realism is the only position which does not render the fact that empirically successful theories have been chosen a miracle. A vast literature discusses the miraculous theory argument, but the miraculous choice argument has been unjustifiably neglected. I raise two objections (...) to Richard Boyd's defense of the latter: (1) we have no miracle free account of the emergence of take-off theories and (2) the anti-realist can account for the non-miraculous choice of empirically successful theories by attributing mere empirical adequacy to background theory. I argue that the availability of extra-empirical criteria that are arguably truth conductive but not theory-laden suffices to answer (1), and the unavailability of extra-empirical criteria that are conductive to empirical adequacy but not necessarily to truth (and are also not theory-laden) constitutes to reply to (2). The prospects for a realist victory are at least somewhat promising, on a controversial assumption about the rate at which empirically successful theories emerge. (shrink)

In some cases where we are faced with a decision of whether to prioritize identified lives over statistical lives, we have no basis for assigning specific probabilities to possible outcomes. Is there any reason to prioritize either statistical or identified lives in such cases? The ‘uncertainty argument’ purports to show that, provided we embrace ex ante contractualism, we should prioritize saving identified lives in such cases. The argument faces two serious problems. First, it relies on the principle of indifference, and (...) as such it leads to inconsistent assignments of epistemic probability to possible outcomes. Moreover, even if the uncertainty argument can be reformulated in order to avoid reliance on the principle of indifference, the uncertainty in such cases still undermines any judgment of which course of action – saving a statistical, or rather an identified life – involves the greater burden. The indeterminacy involved in the statistical group might be thought to undermine the argument that application of the principle of indifference leads to inconsistency in this case, but the thought that it does rests on a misunderstanding of the relationship between indeterminacy and reference. Insightful and learned, the essays combine profound scholarship with the lucid humanity of a teacher aware of the special value of Greek studies in the modern world.

Some compatibilists have responded to the manipulation argument for incompatibilism by proposing an historical theory of moral responsibility which, according to one version, requires that agents be morally responsible for having their pro-attitudes if they are to be morally responsible for acting on them. This proposal, however, leads obviously to an infinite regress problem. I consider a proposal by Haji and Cuypers that addresses this problem and argue that it is unsatisfactory. International borders concentrate opportunities in some societies while limiting them in others. Borders also prevent those in the less favored societies from gaining access to opportunities available in the more favored ones. Both distributive effects of borders are treated here within a comprehensive framework. I argue that each state should have broad discretion under international law to grant or deny entry to immigration seekers; but more favored countries that find themselves under immigration pressure should be legally obligated to fund development (...) assistance for countries that generate immigration pressure. Funding should be subject to conditions of fair and effective use in recipient countries, and should aim at a near-term target of immigration-pressure equilibrium. Equilibrium obtains between two countries when, given appropriate background circumstances, the same proportion of individuals in each manifests a preference to migrate to the other. If meeting the equilibrium target in the short term would be to the long-term disadvantage of the worst-off countries, then a Pareto-superior alternative target supersedes. It mandates development assistance at the level that yields the most favorable human development projections for the worstoff countries. An implementable set of institutions is described that can achieve the equilibrium goal in the long term without unduly sacrificing other important ends, including economic growth, political stability, cultural integrity, the political autonomy of distinct societies, and their proper accountability for policy choices. The law of desire has been proposed in several forms, but its essential claim is that agents always act on their strongest proximal action motivation. This law has threatening consequences for human freedom, insofar as it greatly limits agents’ ability to do otherwise given their motivational state. It has proven difficult to formulate a version that escapes counterexamples and some categorically deny its truth. Noticeable by its absence in the literature is any attempt to provide an argument for the law (...) of desire – I propose such an argument here. It is noted that Sripada's “divided mind” theory of willpower provides a counterexample to the version of the law of desire my argument defends, but I note that a reformulated version of the law of desire survives this critique. I conclude that there is a serious case for the law of desire, and note the broader implications of this. (shrink)

Predictivism asserts that novel confirmations carry special probative weight. Epistemic pluralism asserts that the judgments of agents (about, e.g., the probabilities of theories) carry epistemic import. In this paper, I propose a new theory of predictivism that is tailored to pluralistic evaluators of theories. I replace the orthodox notion of use-novelty with a notion of endorsement-novelty, and argue that the intuition that predictivism is true has two roots. I provide a detailed Bayesian rendering of this theory and argue that pluralistic (...) theory evaluation pervades scientific practice. I compare my account of predictivism with those of Maher and Worrall. This paper summarizes paired courses, a technique that is being used to incorporate the benefits of liberal arts into the business curriculum. This technique pairs a required business course with a liberal arts course that students take concurrently during a semester. The courses have overlapping themes and activities to build specific competencies that are desired by organizations, such as communication, critical thinking and problem solving, emotional intelligence, and organizational professionalism. These competencies are identified by exploring national surveys and conducting a (...) local survey of business professionals. The paired courses utilize a variety of exercises with the ultimate goals of building desired workplace-related skills in students and improving their practical reasoning ability. The exercises do this by strengthening students’ analytical thinking, understanding of multiple framing, and reflective exploration of meaning through various techniques. Many of the activities are explained in detail with some additional resources provided. Teachers can utilize the same activities or adapt them to their classroom. (shrink)

Recently, Doolittle and Inkpen formulated a thought provoking theory, asserting that evolution by natural selection was responsible for the sideways evolution of two radically different kinds of selective units (also called Domains). The former entities, termed singers, correspond to the usual objects studied by evolutionary biologists (gene, genomes, individuals, species, etc.), whereas the later, termed songs, correspond to re‐produced biological and ecosystemic functions, processes, information, and memes. Singers perform songs through selected patterns of interactions, meaning that a wealth of critical (...) phenomena might receive novel evolutionary explanations. However, this theory did not provide an empirical approach to study evolution in such a broadened context. Here, we show that analyzing songs and singers, using patterns of interaction networks as a common ontology for both, offers a novel, actionable, inclusive and mathematical way to analyze not only the re‐production but also the evolution and fitness of biological and ecosystemic interconnected processes. In this paper we study changes of beliefs in a ranking-theoretic setting using non-extremal implausibility thresholds for belief. We represent implausibilities as ranks and introduce natural rank changes subject to a minimal change criterion. We show that many of the traditional AGM postulates for revision and contraction are preserved, except for the postulate of Preservation which is invalid. The diagnosis for belief contraction is similar, but not exactly the same. We demonstrate that the one-shot versions of both revision and contraction (...) can be represented as revisions based on semiorders, but in two subtly different ways. We provide sets of postulates that are sound and complete in the sense that they allow us to prove representation theorems. We show that, and explain why, the classical duality between revision and contraction, as exhibited by the Levi and Harper identities, is partly broken by threshold-based belief changes. We also study the logic of iterated threshold-based revision and contraction. The traditional Darwiche-Pearl postulates for iterated revision continue to hold, as well as two additional postulates that characterize ranking-based revision as a restricted `improvement' operator. We investigate the dual notion of iterated threshold-based belief contraction and provide a new set of postulates for it, characterizing contraction as a restricted 'degrading' operator. (shrink)

This essay critically examines three theories of moral rights, theBenefit, the Interest, and the Choice theories. The Interest andChoice theories attempt to explain how rights can be more robustthan seems possible on the Benefit theory. In particular, moralrights are supposed to be resistant to trade-offs to supportprincipled anti-paternalism, to constitute a distinct dimensionof morality, and to provide right holders with a range ofdiscretionary choice. Recently improved understanding of evolutionary processes suggests that tree-based phylogenetic analyses of evolutionary change cannot adequately explain the divergent evolutionary histories of a great many genes and gene complexes. In particular, genetic diversity in the genomes of prokaryotes, phages, and plasmids cannot be fit into classic tree-like models of evolution. These findings entail the need for fundamental reform of our understanding of molecular evolution and the need to devise alternative apparatus for integrated analysis of these genomes. We advocate the development (...) of integrative phylogenomics for analyzing these genomes and their histories, with tools suited to analyzing the importance of lateral gene transfer (LGT) and of DNA evolution in extra-cellular mobile genetic elements (e.g., viruses, plasmids). These phenomena greatly increase the complexity of relationships among interacting genetic partners, as they exchange functional genetic units. We examine the ontology of functional genetic units, interacting genetic partners, and emergent genetic associations, argue that these three categories of entities are required for a successful integrated phylogenomics. We conclude with arguments to suggest that the proposed new perspective and associated tools are suitable, and perhaps required, as a replacement for the bifurcating trees that have dominated evolutionary thinking for the last 150 years. I aim to show that one way of testing the mettle of a theory of scientific explanation is to inquire what that theory entails about the status of brute facts. Here I consider the nature of brute facts, and survey several contemporary accounts of explanation vis a vis this subject. One problem with these accounts is that they seem to entail that brute facts represent a gap in scientific understanding. I argue that brute facts are non-mysterious and indeed are even (...) explainable by the lights of Salmon's ontic conception of explanation. The plausibility of various models of explanation, I suggest, depends to some extent on the tendency of their proponents to focus on certain examples of explananda - I ponder brute facts qua explananda here as a way of helping us to recognize this dependency. We present an axiomatic model of preferences over menus that is motivated by three assumptions. First, the decision maker is uncertain ex ante (i.e., at the time of choosing a menu) about her ex post (i.e., at the time of choosing an option within her chosen menu) preferences over options, and she anticipates that this subjective uncertainty will not resolve before the ex post stage. Second, she is averse to ex post indecisiveness (i.e., to having to choose between options that (...) she cannot rank with certainty). Third, when evaluating a menu she discards options that are dominated (i.e., inferior to another option whatever her ex post preferences may be) and restricts attention to the undominated ones. Under these assumptions, the decision maker has a preference for commitment in the sense of preferring menus with fewer undominated alternatives. We derive a representation in which the decision maker’s uncertainty about her ex post preferences is captured by means of a subjective state space, which in turn determines which options are undominated in a given menu, and in which the decision maker fears, whenever indecisive, to choose an option that will turn out to be the worst (undominated) one according to the realization of her ex post preferences. Certain realist critics of U.S. foreign policy put forth an alternative model of “offshore balancing” as a definitively rational alternative to what they regard as the current, and utterly disastrous, policy of “liberal hegemony.” They predict that the public will eventually recognize the hollowness of liberalism and demand a foreign policy rooted in hardnosed realism. They also promise that this rational outline will also be a positive good, maximizing national interests and moral values with no tradeoffs between them. I argue (...) that offshore balancing packages realist arguments in an idealist framework, whereby the good is both self-evident and bound to triumph. This inhibits the actual realist task of revealing the harsh facts of politics, which inevitably interfere with preferences. Offshore balancing traps itself between its claim of inevitability, which undercuts the need for advocacy, and desirability, which pushes against its inevitability. The only way they can resolve this contradiction is with an increasingly caustic account of liberalism as so utterly wrong and immoral that its opponents earn the mark of reason and goodness by sheer virtue of their opposition. Offshore balancing subordinates its account of the world as it is to a demand of how the world must not be. (shrink)
